Freehold vs Leasehold Areas in Dubai: What You Can and Can't Buy

Why this is the first thing to check, not the last

Dubai doesn't allow foreign nationals to buy freehold property city-wide — only in areas the government has specifically designated for it. Falling for a unit before confirming its area is freehold is a common and entirely avoidable mistake.

Freehold: full, permanent ownership

In a designated freehold area, a non-UAE national can own the property and the land it sits on, outright and indefinitely, with the right to sell, lease, or pass it on. Most of the areas that get discussed as "Dubai property investment" destinations — Dubai Marina, Downtown Dubai, Business Bay, Jumeirah Village Circle, Dubai Hills, and dozens more — are freehold.

Leasehold: a long-term right to use, not to own

In a leasehold area, a foreign buyer can acquire rights for a fixed term — commonly up to 99 years — but doesn't own the underlying land. It behaves more like a very long lease than an outright purchase: at the end of the term, rights typically revert absent renewal, and structurally it's a different asset than freehold ownership.

Why this matters for financing and exit

• Mortgage lenders are generally far more comfortable — and freehold-only for many products — lending against freehold property, since it's the cleaner collateral.
• Resale liquidity and the comparable-sales data that make an area easy to value (like what powers Keyva's own area pages) are concentrated in freehold areas, since that's where the bulk of the open, cross-nationality market trades.
• Eligibility for the Golden Visa real estate route specifically requires freehold.

The practical check

Before you shortlist a property, confirm its area's freehold status with your agent or directly against the DLD's published freehold area list — don't assume based on the building's marketing materials alone. Once confirmed, compare that area's real transaction history against alternatives before deciding.
